Pair arrested for selling discount weed outside N.J. dispensary, prosecutor says

Two New Jersey residents have been charged after allegations of trying to undermine a licensed marijuana dispensary in Phillipsburg.

Warren County District Attorney James Pfeiffer announced Friday the arrests of a 35-year-old woman from Belvedere and a 38-year-old man from North Arlington, Bergen County, following an eight-week investigation into the city’s alleged unregulated marijuana distribution.

Pfeiffer said the activity was reported to police after the couple were seen selling cannabis outside the dispensary. The state-licensed Phillipsburg dispensary for medical and recreational marijuana for adults is The Apothecarium on South Main Street.

“They parked their car in front of the dispensary and had a sign there that offered marijuana for sale at a discount,” the attorney general told on Friday.

Pfeiffer explained that controlled marijuana is grown by a state-certified facility under controlled conditions, while unregulated marijuana is not.

After a months-long investigation by the Attorney General’s Office of Narcotics Task Force, the Phillipsburg Police Department and New Jersey State Police, authorities executed a search warrant on a 2003 Pontiac Montana pickup truck driven by the male suspect and a 2008 Hyundai Elantra driven by a woman, Pfeiffer said.

Pfeiffer said the search revealed about seven ounces of marijuana seized by authorities, along with the two cars and $540.

Both were released pending a court date and charged with one count of distributing more than one ounce of marijuana and conspiracy to distribute more than one ounce of marijuana. Both are third-degree crimes that carry a maximum penalty of five years in state prison upon conviction.

No lawyer has been listed for the suspect, the New Jersey Supreme Court said Friday afternoon, while the man is represented by Attorney General John McGuigan, who declined to comment.

A letter seeking comment from a spokeswoman for The Apothecarium owner TerrAscend did not immediately respond.
